Lemon Law  

Routine maintenance and repairs on an new vehicle are expected. Sometimes however, your new car, truck, or SUV may need an unreasonable and unacceptable amount of repairs. When this is the case, you may have purchased what is considered a “lemon” under West Virginia law.

You may have a lemon law claim if:

  • You have taken your new vehicle to the dealer to fix the same problem at least three times within the warranty period, and the problem wasn’t fixed.
  • You have had your new vehicle in the shop for at least 30 days for various repairs during the warranty period.
  • You have a persistent problem with your new vehicle that substantially impairs the usage and the vehicle during the warranty period.
